Please read these Terms of Service ("Terms") carefully before using the Tarantella AI Design website at tarantella-ai.design ("the Site") or engaging our video production services. By accessing the Site or engaging our services, you agree to be bound by these Terms.
1. Services
Tarantella AI Design provides custom AI video production services including, but not limited to, marketing videos, memory films, AI avatars, educational content, meditation videos, and event highlight videos. Specific deliverables, timelines, and pricing are agreed upon individually for each project.
2. Project Agreements
Each project is governed by a separate agreement or proposal that outlines scope, deliverables, timeline, and payment terms. These Terms apply generally to all engagements; the project-specific agreement takes precedence in the event of any conflict.
3. Payment
Payment terms are specified in each project proposal. We typically require a deposit before commencing work. Final deliverables are provided upon receipt of full payment. All prices are in USD unless otherwise stated.
4. Intellectual Property
Upon receipt of full payment, you receive a license to use the final delivered video content for the purposes described in the project agreement. Tarantella AI Design retains the right to display completed work in our portfolio unless you request otherwise in writing.
You represent that any materials you provide to us (photos, logos, scripts, etc.) do not infringe on any third-party intellectual property rights, and you grant us a license to use them for the purpose of completing your project.
5. Revisions and Scope
The number of revisions included is specified in each project proposal. Additional revisions or scope changes beyond the agreed terms may incur additional fees.
6. Turnaround and Delivery
Estimated timelines are provided in good faith but are not guaranteed. Delays caused by late provision of materials, feedback, or approvals from the client may extend the timeline.
7. Cancellation
If you cancel a project after work has commenced, deposit payments are non-refundable. Work completed up to the point of cancellation may be invoiced proportionally.
8. Limitation of Liability
To the maximum extent permitted by law, Tarantella AI Design shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount paid for the specific project giving rise to the claim.
9. Website Use
You agree not to use the Site in any way that is unlawful, harmful, or disruptive. We reserve the right to restrict access to the Site at our discretion.
10. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal proceedings.
12. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the updated Terms.
